A Sanctuary on Blueberry Lake
Renters' Agreements:

You agree that you shall leave the premises in the same order as you found them and that you shall not exceed the number of guests identified in this Agreement. If more persons are found to occupy the unit there is a $200. per night fee in addition to the rental fee, or if excessive cleanup is required, a $200.extra cleaning fee will be charged and deducted from the Security Deposit and will be communicated to you by email or phone after owner or representative inspects property upon your groups departure. You agree to return keys to Property upon departure. You shall be responsible for any damage to the premises in excess of the Security Deposit, plus reasonable costs of collection, including reasonable attorneys' fees if needed. Damage caused by your guests or invitees shall be your financial responsibility and paid in full within 30 days of departure.

Without our prior written permission, you shall not host special events or gatherings at Sanctuary involving more than your registered party, and shall not conduct any events or activities that might interfere with the peace of the property's neighbors. Gatherings larger than your registered party will be assessed event facility fees and cleaning fees. Sanctuary provides catering services and concierge services for 2-100 persons with advance notice subject to availability. Please consult with event planner/owner Rita Brown, (802-583-1156).

You agree that there are no pets allowed, unless specified and an additional $200.fee has been collected, and that there is to be no smoking in the house, except on the screened porch, and outdoor decks. Such violations will result in automatic and total forfeiture of the Damage Deposit. You agree that the Property Manager or our designee may enter and inspect the premises for any reason at any reasonable time during your stay, if the above is in question.

Upon departure, you agree to follow the check-out procedures including, cleaning the outdoor grill if used, filling dishwasher and starting it, placing the garbage in the outdoor trash cans and putting any used towels in lower level bathtub, stripping beds of sheets and pillowcases only and leaving in lower level by laundry room door.

Children are the direct responsibility of you
as well as their parents or caretakers. Children under 12 years of age are NEVER TO BE LEFT UNATTENDED at Sanctuary, whether in the house or outdoors, near the lake or hot tub. You acknowledge that there is a lake and a hot tub on the property and other amenities that could be dangerous to children and others. You also acknowledge and accept that there will be no lifeguard or any other supervision on the premises during your stay, and we will not be responsible for supervising the use of any of the above by either adults or children. You and all of your guests and invitees undertake all use of the property at your own risk. You also acknowledge that the balcony off the master bedroom is potentially dangerous to children and others if left unattended or used in a negligent manner. You also acknowledge that use of boats or rafts present on property or belonging to neighbors cannot be used without permission and that the owner takes no responsibility for any injuries or death that may result from use with or without permission. You also acknowledge that the Tower Room, in case of fire, has no escape except for the emergency escape ladder, which drops down from the window, and that we do not advise anyone sleep in this room.

You agree that no laws, statutes or ordinances of a jurisdictional government unit will be violated on the premises. You also agree that should Owner incur any expenses in enforcing the terms of this agreement, you shall reimburse Owner 100% for such expenses. No parking on road, no exceptions ever. There is additional parking next door if needed with adjoining field for event parking. Please move cars next door if more than 10 inches of snow is expected. Our plower comes early AM. Parking on road will result in a large fine from town of Warren.

YOU AGREE TO INDEMNIFY OWNER AND SAVE OWNER HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LIABILITIES AND EXPENSES, INCLUDING REASONABLE ATTORNEY FEES IN CONNECTION WITH LOSS OF LIFE, PERSONAL INJURY AND/OR DAMAGE TO PROPERTY ARISING FROM OR OUT OF ANY OCCURRENCE IN, UPON, OR ABOUT THE LEASED PREMISES, INCLUDING GROUNDS ADJACENT TO THE PROPERTY, OCCASIONED BY AN ACT OR OMISSION OF YOU, YOUR AGENTS, EMPLOYEES, INVITEES OR OTHER OCCUPANTS.

Owners' Agreements: We will bear the cost of all utilities, trash and recycle removal, local telephone & cable services, snow removal, and lawn care. We will provide a fully furnished house complete with linen and amenities, as noted in our advertising. We will take every reasonable measure to ensure that everything advertised in house is present and in working order. In the event that any of the major features (Jacuzzi, hot-tub, major appliances) are not working upon arrival or during rental, upon notification from renter, we reserve the right to have 24 hours to repair or replace it. If, after 24 hours, this is not possible, we will refund up to 10% rental fee to be agreed upon by owner and renter. Owner agrees to have Property Manager or other person reachable by phone to deal with any problems that may arise, as well as providing contact sheet with service phone numbers. Failure for Property Manager to respond in a timely manner (12 hours) may result in refund of portion of rental (not to exceed 5%) and to be negotiable between owner and renter.

Pending Reservation: This reservation will become confirmed upon receipt of your deposit within 24 hours of booking and receipt of this Renter Agreement, signed and completed by you within 10 days of receiving this agreement by email unless it is a last minute booking and time is of the essence within the 10 day grace period, then it must be returned ASAP.
Payment: MasterCard, Visa, American Express, Cashier Check, Money Order or Bank Wire confirms your reservation with 50% deposit. We reserve the right to offer rental of Sanctuary to another party if after 24 hours payment has not been received. We will make every attempt by phone and email to notify you if we have not received payment. Signed agreement must be received by email, fax or mail within 10 days of receiving this.

Final payment, including tax and security deposit, is due 60 days prior to arrival. If reservations are made within 60 days of arrival, full payment, taxes and security is due immediately. If personal check is sent initially or for the final balance 60 days prior, please overnight check in advance, as we need to allow 5 extra days to process.

A PayPal credit card request will be automatically emailed to you 5 days prior to the 60 day deadline. If we do not receive final payment by the 60-day deadline, we reserve the right to cancel your reservation and the deposit will be forfeited. We will notify you by phone/email before taking action. Please respond to your final balance request.

Cancellations: In the event of cancellation of this contract, Sanctuary retains all rental funds receive, as liquidated damages, unless Sanctuary is re-rented at the same rate for the same time period. If the latter occurs, we retain $100 administrative fee and 10% commission fee. We have a stringent policy as we have only one Sanctuary to rent and your deposit assures that we will honor your reservation, even if we could rent it for a longer time period or for a higher rate. We hope you understand our business position. The owner reserves the right in extenuating circumstances to make the decision whether to offer the renter the opportunity to credit the non-refundable deposit towards a future non-holiday, mid-week stay based on availability, less $100 administrative fee and 10% commission fee. This is at the sole discretion of the owner, based on the circumstances. There is no refund for early departure, no exceptions!
Security Deposit: The Security Deposit is provided as security against damage to the house or property, theft, late check out, and violation of any of the renter's agreements contained in this Agreement. Final settlement of the Security Deposit will be made as soon as possible, but in no event later than 30 days after the departure date. Sanctuary is a fairly new house and inspection will be done prior to and after each rental. Any discrepancy needs to be reported to the property manager immediately and in writing within 3 days of departure.

Arrival/Departure Times: Check- in starts at 4 PM on the arrival date and departure must occur by 10 AM on the departure date. Early check-in and late checkout times are possible by prior arrangement, but can only be confirmed several days before the arrival date. Pet Fee/Deposit: There is a $200 fee to cover the additional cost of shampoo and upholstery cleaning, so that Sanctuary will be hypoallergenic for future guests. No cats, please.
